PURCHASE CONDITIONS
1. – Recitals and definitions
1.1 For the purposes of these General Conditions, the
following terms will have the meaning indicated therein, except where otherwise
specified in relation to the context:
- “Carrier”: indicates Wind Jet S.p.A., with registered office in Baglio della
Sementa SP 69/II° 95121 Passo Martino (CT), VAT no. 04027610874, supplying the
transport service for passengers and luggage, which is the object of these
general conditions;
- “Passenger”: indicates any individual, different from the aircrew members in
charge of the flight, transported or to be transported by the carrier;
“Luggage”: indicates the good being property or possession of the passengers
and accompanying them during the journey; luggage indicates both checked and
unchecked luggage;
- “Checked Luggage”: indicates the luggage taken into custody by the carrier
and for which a Luggage Identification Label is issued;
- “Unchecked Luggage”: indicates the hand luggage carried on board by the
aircraft passengers themselves;
- “Call Centre”: indicates the carrier's telephone support centre that the
passengers may contact to get general information about flights and ticket
purchasing as well, or even to purchase tickets directly;
- “Infant”: passengers under 24 months.
2. - Acceptance of general conditions
The Carrier has the right to update or change these general conditions at any
time and will communicate any such change without any delay by means of this
site.
These conditions must be examined online by passengers.
If the reservation is made online, passengers commit and bind themselves to
print and store these conditions; passengers also commit and bind themselves to
print and store these conditions again any time a modification is added.
The reservation and the associated purchase of the ticket therefore entail a
thorough knowledge of these conditions.
3. - Reservations and online ticket purchasing
3.1 The ticket can be purchased through this website
(www.volawindjet.it), by contacting the Call Centre, at the ticket offices of
the airport handler or at the travel agencies that are registered to the
service.
The Call Centre can be contacted at the following phone number: 89.2020. The
call will be charged € 0.96 (VAT included) per minute and € 0.12 for call set
up charges, from both mobile line and landline. The cost from mobile line
varies depending on the phone provider in use; calls coming from foreign
Countries are charged according to local rates.
3.2 Reservations require the immediate payment of the ticket.
Once the settlement of the rate and of all the applicable taxes and surcharges
has been ascertained, the Carrier will confirm the reservation and communicate
the Reference Code to the passenger.
Should the payment be not settled or executed, the Carrier has the right to
cancel the reservation.
3.3 In case of online ticket reservation by
means of the website the Carrier will transmit to the passenger an online
ticket purchase confirmation complete with the Reservation Reference Code and
the flight summary data.
Should the ticket be purchased at a travel agency, it is the travel agency that
will provide the passenger with the summary of the reservation and the relevant
reference code.
3.4 Tickets can be bought up to 3 hours
before the departure of the related flight by calling the Call Centre or up to
1 hour before flight departure in the airports where the airport handler has
its ticket office.
3.5 The tickets will only be Economy Class tickets and may be
one way or return tickets. Wind Jet S.p.A. does not guarantee the rerouting for
possible transits from and to other carriers. Wind Jet S.p.A. does not
guarantee the transfer of passengers and of their related luggage on other
flights.
4. - Rates and payment modes
4.1 The rate only includes the transport from the departure
airport to the arrival one.
The rates applied are those valid when the ticket is purchased and may only be
applied to a limited number of seats available.
The carrier reserves the right to deny transport if the applicable rate has not
been paid in advance.
4.2 Without prejudice of the provisions on luggage transport
set by the following art. 10 of these conditions and in addition to the rate,
the passengers will be charged, for every single purchased ticket, all the
taxes imposed by the Government or any other authority - airport authorities in
particular - on passengers or their luggage or on the usage of all the
services, the "operations & security" tax, the surcharge and fuel
surcharge, the administrative rights and the issue charges. Rates, taxes,
surcharges, administrative rights and issue charges will be paid in the
currency required by the carrier upon ticket purchasing at the published rate.
4.3 The different reservation classes also called fare basis
are grouped into two different categories:
a) Rates belonging to the category “Best” – No change allowed.
b) Rates belonging to the category “Flex” – They grant the
passenger the right to request for a change of the name, hour, day or leg of
the reservation in accordance with the regulations set forth by the following
art. 6.1.
4.4 Passengers under 2 years of age shall travel seated on an
adult's lap. They have not the right to bring additional luggage to those of
the accompanying passenger.
4.5 The payment for purchases made on line or through a Call
Centre may be settled with a Credit Card belonging to the Visa and Mastercard
circuits.
The purchase can be paid cash, by cash card or by the above mentioned credit
cards at the ticket offices of the airport handler.
As far as purchases executed at travel agencies are concerned, the payment mode
is to be checked directly at the agency.
4.6 Confidentiality.
In order to guarantee the confidentiality of the data of the credit cards used
for on line operations, the Carrier uses the most advanced technology of Secure
Socket Layer (SSL).
5. - Wind Jet Carnet
The carnet is valid for one year from the purchase. It consists of a certain
number of codes, enabling the issue of the same number of one-way tickets (one
leg, e.g. Catania – Rome, one way). The carnet is strictly bound to the name/s
entered during purchase operations and is valid only for the national leg/s
chosen upon purchase, based on the type of carnet actually used. Once the
purchase has been successfully carried out, the customer will be sent an e-mail
with the codes to be used for the issue of the relevant tickets. The tickets
can be issued through the Wind Jet web site. Departing from the provisions of
the general conditions of the Wind Jet agreement, neither the leg nor the name
can be changed (in case of personal carnet and commuter carnet). Changes of
date, of leg, where possible (network carnet), and changes of name between
carnet holders only, where possible (business and network carnet), will be
charged with the penalties normally applied to the changes of standard tickets,
possible rate adjustments excluded. If the leg selected for the carnet is no
more operated by Wind Jet, the customer will be refunded the cost of the
tickets still to be used (to assess the value, the whole price of the carnet
–purchase cost excluded- will be divided by the coupons still to be used).
Otherwise, all the coupons still to be used can be transferred to a different
leg operated by Wind Jet. If the flight is cancelled, passengers will have the
right to be re-routed on a different Wind Jet flight. Otherwise, renouncing the
flight, the validation of the coupon will be cancelled so that the coupon can
be used again. Wind Jet does not carry unaccompanied minors under 14. Art. 8.6
will be applied in these cases. Would carnet codes not be used for Wind Jet
S.p.A. flights within one year from carnet purchase, only the airport taxes of
the codes not used will be refunded. The “Carnet Cost” item will not be
refunded.
6. - CHANGES, CANCELLATIONS AND DELAYS
6.1 Only if the rate paid for the purchased ticket belongs to
the category “Flex”, passengers will have the right to request for the
modification of the name or date or flight or leg indicated on the ticket by
calling the Call Centre and the agencies associated, without prejudice of the
penalties listed below.
The change of name and date, time and leg of the flight will be allowed if
requested within 3 hours before the departure, and it will be subject to the
opening time of the Call Centre and of the ticket offices of the airport
handler.
As for the change of the name, the penalty applied will account for € 40.00 per
changed name of the same ticket; the penalty applied to change the date, leg
and flight will account for € 30.00 per change requested.
If the price of the already bought and confirmed ticket is lower than the price
of the new flight, besides paying the charge detailed above, passengers shall
also pay the difference between the original price and the lowest Flex rate
available when the change is requested. If the latter is lower than the rate
paid on line, no refund will be provided. "New flight" indicates also
the leg being the object of the change on the original flight, which is
generated when changing the name.
Also in case of modification concerning the “change of name”, both penalties
will be applied; more specifically, both the charge accounting for 40.00 Euro
per change and the payment of the difference between the price originally paid
and the lowest Flex rate available when the change is requested. If such a rate
is lower than the originally paid price, no refund will be provided. The change
of name will not be allowed if at least one leg of the flight has already been
carried out or has expired.
In the tickets of multi-leg flights the name of the passenger shall be the same
for all the legs. In case of request for change of leg, national flights can
only be substituted by other national flights and international flights can
only be substituted by other international flights.
The change of name will entail the assignation to the new ticket owner of all
the previously purchased Additional Services that are indicated on the ticket
and that belonged to the previous owner (individual passenger) for whose name a
change has been requested. No refund will be provided for surcharges or
additional services previously purchased.
In case of leg change from a flight where a surcharge is requested for the load
of checked luggage into the hold -and if such surcharge has already been paid
by the passenger - to a flight where such a surcharge does not apply, the
passenger will keep the same conditions as previously purchased but will lose
any right to be refunded any cost paid for the surcharge. In case of excess
luggage weight passengers shall pay € 10.00 per exceeding Kilogram. For the
tickets purchased before 27.10.2009, excess luggage will be charged € 8.00/Kg.
The amount of the excess luggage cost and the modes of excess luggage payment,
as well as the provisions for the admissibility and/or the prohibition to add
up the weight of the different pieces of luggage of single passengers and of
the passengers indicated on the same ticket attending check-in counters
together, will be regulated by the provisions of the art. 10 below.
In case of leg change from a flight where no surcharge is requested for the
load of checked luggage into the hold to a flight where such a surcharge
applies, only paying € 7.00 per single item, the passenger will have the
faculty to load into the hold a maximum of three checked pieces of luggage with
an overall weight limit of 20 Kg. The weight of the three pieces of luggage of
each passenger may be added up, but the overall weight shall not exceed 20 Kg.
The weight of the single pieces of luggage of different Wind Jet passengers can
be added up if passengers are indicated on the same ticket and if each one of
them paid for their own luggage, provided that they attend the check-in counter
together.In case of excess luggage weight passengers shall pay the difference
in luggage weight; the cost of excess luggage is € 10.00 per Kilogram.
Passengers are allowed to check further luggage for transportation in the hold
but the weight, starting from the fourth checked piece of luggage, will be
entirely calculated as excess luggage at a cost of € 10.00 per Kilogram. For
the tickets purchased before 27.10.2009 excess luggage will be charged €
8.00/Kg. The payment of the amount due for excess luggage is always settled for
every single flight in the relevant airport at the ticket office of the airport
handler, which will charge passengers with a fee for the collection and issuing
of the ticket. Such fee varies depending on the airport handler operating in
the different airports. The maximum checked hold luggage allowance and the
weight limit are intended per single passenger, are personal and may not be
accumulated and/or shared with those of other passengers. The weight of the
single pieces of luggage of different passengers can be added up only in case
of passengers indicated on the same ticket and if each one of them paid for
their own luggage, provided that they attend the check-in counter together. The
payment of € 7.00 per piece of hold luggage (max 3 pieces) shall be settled
together with the request for leg change or even during a subsequent stage on
our website, but within three hours before flight departure. The payment of the
amount due for each piece of excess luggage may be made on our website or also
at the airport, in which case passengers will be charged by the handler with a
fee for the collection and issuing of the ticket. Such fee varies depending on
the airport handler operating in the different airports. Passengers will lose
their right to transport the checked luggage in the hold for free with the
overall weight limit of 20 kg as previously purchased concerning the original
leg. Whichever the case, the provisions under art. 10 below concerning the cost
of the pieces of hold luggage (max. 3 pieces of luggage per passenger), the
amount of the excess luggage cost and the modes of payment, as well as the
provisions for the admissibility and/or the prohibition to add up the weight of
the different pieces of luggage of single passengers, will apply.
This article 6.1 is hereby expressly stated not to apply if the ticket has been
purchased at a rate belonging to the category “Best”.
6.2 Passengers not attending the boarding gate within the
fixed time will be charged with the whole cost of the ticket and may request
for the refund of airport taxes only, by sending a formal written request by
means of a recorded delivery letter.
6.3 Passengers renouncing to use the service for reasons not
due to the Carrier may only request for the refund of airport taxes by sending
a formal written request by means of a recorded delivery letter.
6.4 If passengers are prevented from departing for causes not
depending on them, in that case the provisions of art. 945 of the legislative
decree no. DLT 09.05.2005, in force since 02.11.2006, will apply. In any case,
the Carrier shall be notified the prevention without any delay.
6.5 In case of flight cancellation, overbooking or prolonged
delay, passengers have the rights established by the EC standard (reg.
261/2004/EC ).
6.6 Passengers may claim for refund by sending a formal
written request by means of a recorded delivery letter and enclosing to it the
reservation code and the bank details for the payment of the amount, if due.
6.7 By means of a written request sent by
recorded delivery letter, passengers have the faculty to request for a free
ticket, as an alternative to the monetary refund. They will have the right to
choose the ticket freely on the same national leg covered by the Carrier.
7. - TRANSPORT CONDITIONS. CHECK-IN
7.1 Passengers shall attend the airport in due time for
completing, before flight departure, all the check-in operations; the carrier’s
check-in counter opens two hours before the scheduled departure and closes
compulsorily 40 minutes before the flight.
7.2 The day of the scheduled departure passengers shall attend
the check-in counter with a valid ID. Passengers shall also show the valid
documents required by the law of the destination countries to enter their
territory.
Passengers have the exclusive responsibility of making sure they possess a
valid ID and any further requirement or document required by customs and
immigration authorities. Penalties, sanctions, expenses or costs due to the
lack of such requirements or of valid documents will be charged to the
passengers. Passengers are requested to address the Immigration authorities of
the destination countries for possible clarifications before purchasing the
ticket.
If the documents shown by passengers are not valid, or if the name of the
passenger written on the reservation does not match the one indicated in the
ID, the Carrier will deny boarding and consequently the price paid for
purchasing the ticket will be lost, except for the airport taxes, that will be
immediately refunded.
We specify that passengers shall attend the check-in counters with a valid ID
with photo. The following valid documents will be accepted at check-in
counters: valid passport, driving licence with photo if issued by the
Prefecture, identity card with photo, valid for travel abroad in case of
international flights even in case of flights directed to the countries of the
Schengen area, and the international student card with photo. National identity
cards will be accepted only if they are issued by one of the Schengen countries
or by a country that has signed a bilateral agreement with the countries of
this convention.
7.3 Passengers shall attend the boarding gate at least 30
minutes before the flight’s scheduled departure time. The boarding gates close
15 minutes before the flight’s scheduled departure time. Passengers arriving
late will not be accepted onboard and will lose any right to ticket refund,
except for airport taxes only.
7.4 Wind Jet does not allow to check-in directly at the gate.
7.5 Where allowed by the carrier, WEB check-in can be
required. In this case, it will be possible to print the boarding card and
choose one’s seat on the aircraft, at any time after the ticket purchase and in
any case within 3 hours from the flight’s scheduled departure time, subject to
the seats availability.
WEB Check-in can be requested by adult passengers leaving from the airports
indicated by the vector and travelling with hand luggage only, within the
weight and size limits allowed (maximum weight: 10 kg; maximum size: cm 115
[55x35x25]) and observing the regulations concerning the allowed or prohibited
items. WEB Check-In CANNOT be requested by passengers travelling with hold
baggage, by minor passengers or passengers travelling with children under 2, by
passengers with reduced mobility, visually handicapped persons and/or
passengers needing special assistance in the airport, and finally, by
passengers travelling with pets
7.6 Passengers that required the WEB Check-in fee service
shall autonomously check which is the boarding gate of their flight once in the
airport. After checking the gate, passengers shall go to the boarding gate with
a valid ID and the printout of their electronic boarding card within 30 minutes
before the flight’s scheduled departure time. If passengers do not observe the
terms above, the ticket will be cancelled and no refund will be possible for
the denied boarding and for the Web Check-In service, except for airport taxes
only.
7.7 If passengers that already carried out the WEB Check-in
decide to carry hold baggage -that means that they are in one of the conditions
precluding the WEB CHECK-IN service as provided for by art. 7.5- they will lose
their right to use the electronic boarding card. The price paid for the already
bought WEB CHECK-IN service will not be refundable.
Passengers attending the boarding gate after the check-in closure (40 min.
before the flight), thus infringing art. 7.5, will loose the right to the
flight and will have the right to claim for the refund of airport taxes only.
7.8 If passengers attend the security check point without the
electronic boarding card purchased through the WEB Check-in service, they will
not be allowed to use this service and, hence, they shall go to the check-in
counter for standard check-in procedures. If the check-in counter is already
closed (in any case, the time limit for check-in operations is of 40 minutes
before flight’s departure), passengers will lose the right to board with the
consequent loss of the right to be refunded the already paid ticket, except for
airport taxes only. No refund will be granted for the WEB CHECK-IN service.
7.9 This service costs € 3.00 per passenger; passengers are
fully responsible for observing the safety regulations concerning any object
they wish to carry onboard.
7.10 Passengers accept the condition that seat selection is
not binding for the airline. If the Captain (or through a third party, the
Flight attendant) asks them to change seat, they will obey this request as
provided for by the navigation code and by the provisions of the regulations;
or also, if it is necessary for safety reasons.
7.11 If passengers used the WEB CHECK-IN service and,
subsequently, requested the carrier for a change of date and/or name and/or leg
for the purchased ticket, pursuant to the general conditions of the carrier,
and in the cases admitted, they will not have the right to ask for any refund
of the WEB CHECK-IN service requested and paid in advance concerning the ticket
for which, then, they requested the “changes” detailed above. Consequently, if
passengers wish to use the WEB CHECK IN service they shall ask again for a new
WEB CHECK-IN for the new ticket, as it has been changed.
7.12 If the carrier re-routes passengers to a different
flight, even for reasons internal to the airline, Wind Jet S.p.A., through its
help desk, will assign for free to the passengers a new seat, that can be
different from the one previously chosen by the passengers and assigned to the
same carrier. Otherwise, Wind Jet S.p.A. reserves the right to refund the
service purchased before.
8. - Special assistances (Passengers with special
requests)
8.1 For each type of assistance or for the transport
procedures of newborn babies, pregnant women, handicapped persons needing
wheelchairs or having ambulatory difficulties passengers are required to
contact the Call Centre before purchasing the ticket. Special assistances can
be booked exclusively at the Call Centre at the number 89.2020. Such requests
shall be received within 48 hours before the flight’s scheduled departure time.
The seats are limited. Failure to make this communication at the time of
purchase will imply the service not being available at the passenger’s arrival
at the airport and the consequent transport denial.
Similarly, passengers shall contact the Call Centre before purchasing the
ticket for transporting bicycles, surfboards, ski, pets, music instruments. The
transport is subject to the additional rate specified under art. 10.4, 10.5 and
10.11. Wet-battery powered wheelchairs cannot be transported.
8.2 Passengers with plasters, asthma, pacemakers or whose
physical conditions are such as to need medical assistance shall possess the
medical certificate stating their flight fitness; otherwise, the Carrier will
deny transport.
8.3 Wind Jet denies transport to persons on stretchers or
passengers needing oxygen bottles during the flight.
8.4 Passengers with mechanical limbs are allowed to bring
small carbon dioxide cylinders (including a sufficient number of spare
cylinders for the journey).
8.5 Pregnant women– When making their
reservation through the Call Centre passengers are required to inform the
operator about the pregnancy and the pregnancy month. If the pregnancy is at
the fourth last week the passenger will be required to show a medical
certificate which specifies the esteemed birth date, the absence of
complications and the flight fitness. For multiple pregnancies the certificate
shall be showed when the pregnancy enters the 28th week.
8.6 Minor passengers – Passengers until 13,
or unaccompanied by minor passengers, will be accepted on the carrier’s
aircrafts after paying the appropriate surcharge (€ 25.00 per leg per each
unaccompanied minor) and after completion of the related minor protection
procedure. The identification and contacts of the person accompanying the minor
to the departure airport and of the one taking his/her custody at the arrival
will be required. The person accompanying the minor at the departure shall wait
in the airport for 30 minutes after the effective departure of the flight. The
person accompanying the minor shall make sure that the minor attends the
airport with the ID needed for the flight (see 7.2).
8.7 Visually handicapped, hearing-impaired and deaf-mute
passengers – Passengers shall give communication of their status
both during the reservation procedures and at the check-in in the airport. If
the passenger requires assistance in the airport this shall be requested as
specified under section 8.1.
Wind Jet admits onboard guide-dogs for the visually-handicapped and/or the
hearing-impaired. Passengers have the duty to inform Wind Jet in advance about
their intention to travel with a guide-dog by contacting the Call Centre.
Guide-dogs are admitted onboard only if passengers possess an official document
issued by an organization certified for training assistance dogs stating that
the dog is perfectly trained for being a guide-dog. The dog shall wear the
appropriate identification harness. Onboard there is no availability of free
seats for guide-dogs that consequently will have to remain on the floor at the
feet of their owner.
8.8 Transport of pets – The carrier accepts
to transport small pets like cats, dogs and ferrets in the passenger cabin. For
any other species of animals passengers shall contact the Call Centre in
advance to get a written authorization. A maximum of two animals per cabin will
be accepted with a rate of € 30.00 for national flights and € 40.00 for
international flights. Possible requests for animal transport in the passenger
cabin shall be submitted upon ticket purchase, subject to place availability in
the cabin and provided that all the conditions detailed below are met.
The weight of the animal and the cage must not exceed 10 kg. Passengers are
responsible for placing their animals in a strong and safe cage. The cage shall
have a completely waterproof bottom and an opening that allows correct
ventilation but prevents the animal from escaping or exposing. Furthermore the
animal shall not give forth a bad smell and shall stay exclusively in the cage.
The carrier reserves the right to deny animal transport if the criteria above
are not met. The carrier further denies any and all responsibility for possible
inconsistency with the laws of the landing country. The cage shall not exceed
the following size: length: 48 cm; width: 33 cm; height: 29 cm. A maximum of 5
animals of the same species may be carried in the same cage; in this case, the
weight of the animals and the cage shall not exceed 7 kg.
The health certificate of the veterinary indicating all the vaccinations shall
be shown; for international flights, the European Passport for pets shall be
shown too. Animal transport shall be permitted by the laws of the country where
the aircraft will land. No animal will be allowed in the hold. No rodents will
be allowed.
The carrier reserves the right to deny animal transport if the criteria above
are not met. Without prejudice of the following provisions, the passengers
authorized to transport a small pet in cabin are compelled to keep the animal
in the cage during the whole flight and to the carrying out of all the relevant
operations. In order to check that onboard the aircraft there
is enough room for the transport of objects and animals, passengers shall
contact the Call Centre in due time before the departure.
In case of failure to do so, the acceptance of such objects and animals could
not be guaranteed during check-in operations. The applicable rates for luggage
transport shall be paid when they are checked during check-in operations. The
applicable rates for animal transport shall be paid when purchasing the ticket.
9. - Transport denial or limitation
The Carrier may deny boarding or transport continuation to the passenger or the
luggage or may cancel the passenger’s reservation if:
- the behaviour, the mental or physical status or conditions of the passenger
are such to:
- make it necessary for the carrier to provide a special aid, that the carrier
is not able to provide or that it is able to provide but under too hard
conditions; or
- cause great and repeated inconvenience; or
- expose him/herself and/or the other passengers and/or the flight staff or
objects to a danger;
If the transport service cannot be performed by the carrier due to one of the
reasons above or if, due to one of them, the carrier denies boarding the
passenger, the latter will be granted no refund except for the shipping fees.
10. - Luggage
10.1 Only paying € 7.00 per item, passengers will have the
right to carry into the hold three pieces of checked luggage with a maximum
overall weight of 20 Kg for both national and international flights. three
pieces of luggage of each passenger may be added up, but the overall weight
shall not exceed 20 Kg. The weight of the single pieces of luggage of different
passengers can be added up in case of passengers indicated on the same ticket
and if each one of them paid for their own luggage, provided that they attend
the check-in counter together. The weight of the three pieces of luggage of
each individual passenger may be added up but the overall weight shall not
exceed 20 Kg. In case of excess luggage weight passengers shall pay the
difference in luggage weight; the cost of excess luggage is € 10.00 per
exceeding Kilogram. Passengers are allowed to check further luggage for
transportation in the hold but the weight, starting from the fourth checked
piece of luggage, will be entirely calculated as excess luggage at a cost of €
10.00 per Kilogram. The payment of the amount due for excess luggage is always
settled for every single flight in the relevant airport at the ticket office of
the airport handler, which will charge passengers with a fee for the collection
and issuing of the ticket. Such fee varies depending on the airport handler
operating in the different airports. The maximum checked hold luggage allowance
and the weight limit are intended per single passenger, are personal and may
not be accumulated and/or shared with that of other passengers, except for the
provisions reported above concerning passengers indicated on the same ticket,
each one of whom paid for their own luggage, provided that they attend the
check-in counter together. The payment of € 7.00 per single piece of hold
luggage (max 3 pieces) shall be made upon ticket purchasing or even during a
subsequent stage on our website but compulsorily within three hours before
flight departure. The payment of the amount due for every single excess luggage
may be made on our website or also at the airport, in which case passengers
will be charged by the handler with a fee for the collection and issuing of the
ticket. Such fee varies depending on the airport handler operating in the
different airports. For all tickets purchased before 27.10.2009, excess luggage
will be charged € 8.00/Kg even in all the cases described in the following
articles 10.3, 10.4 and 10.11.
Passengers are required to mark all the pieces of luggage to be checked with
their name and address as required by the Authority.
Infant passengers (0-23 months) have no right to carry checked luggage. For
the transport of pushchairs, perambulators and travel cots no
extra charge is due; they may be brought up to the ramp and/or
the hatch of the aircraft where they will be taken into custody by the flight
staff and placed into the hold. Passengers may anyway deliver them during
check-in operations together with the luggage, if they want to. During Wind Jet
flights, onboard the aircraft each passenger is allowed to carry one single
piece of unchecked hand luggage for free in the passenger cabin with a maximum
weight of 10 kg and maximum linear dimensions of 115 centimetres (55x35x25).
10.2 Even on code sharing flights operated by
the carrier Meridiana (Catania – Turin / Turin – Catania; Catania – Verona /
Verona – Catania; Catania – Venice / Venice – Catania; Catania – Rome
(Fiumicino airport) / Rome (Fiumicino airport) – Catania; Palermo – Verona /
Verona – Palermo; Palermo – Rome (Fiumicino airport) / Rome (Fiumicino airport)
– Palermo) only paying € 7.00 per item, passengers will have the right to carry
into the hold three pieces of checked luggage with a maximum overall weight of
20 kg. The weight of the three pieces of luggage of each Wind Jet passenger may
be added up but the overall weight shall not exceed 20 Kg. The weight of the
single pieces of luggage of different Wind Jet passengers can be added up if
passengers are indicated on the same ticket and if each one of them paid for
their own luggage, provided that they attend the check-in counter together. If
the above mentioned weight allowance of 20 Kg. is exceeded, excess luggage will
be charged € 10/Kg. Wind Jet passengers are allowed to check further luggage
for transportation in the hold but the weight, starting from the fourth checked
piece of luggage, will be entirely calculated as excess luggage at a cost of €
10.00 per Kilogram. The payment of the amount due for excess luggage is always
settled for every single flight in the relevant airport at the ticket office of
the airport handler, which will charge passengers with a fee for the collection
and issuing of the ticket. Such fee varies depending on the airport handler
operating in the different airports. The payment of € 7.00 per single piece of
hold luggage (max 3 pieces) shall be made upon ticket purchasing or even during
a subsequent stage on our website, but within three hours before flight
departure. The payment of the amount due for each piece of excess luggage may
be made on our website or also at the airport, in which case passengers will be
charged by the handler with a fee for the collection and issuing of the ticket.
Such fee varies depending on the airport handler operating in the different
airports. In case of flights operated by Meridiana, each passenger is allowed
to carry one single piece of unchecked hand luggage for free in the passenger
cabin with a maximum weight of 8 Kg.
10.3 Only on flights from/to France and on all flights from/to
Russia each passenger is allowed to transport for free in the hold one piece of
checked luggage with an overall weight limit of 20 Kg.; in case of excess
weight passengers shall pay the weight difference of the luggage, the excess
luggage cost being € 10.00 per Kg. The maximum checked hold luggage allowance
is intended per single passenger, is personal and may not be accumulated and/or
shared with that of other passengers.The weight of the single pieces of luggage
of different passengers can be added up if passengers are indicated on the same
ticket, provided that they attend the check-in counter together.
10.4 The transport of equipment for golf, ski, fencing,
windsurfing and of sporting equipment in general is subject to an extra charge
of € 30 per flight and per object up to a maximum of 20 Kg. If this limit is
exceeded, the luggage shall be charged with occording to the rates in force for
excess luggage (€ 10.00/Kg).
10.5 For the transport of scuba gears an extra charge of € 90
is due per flight and per object; the transport of bicycles is charged € 40 per
flight and per object. Passengers are required to provide these items with the
necessary packing.
10.6 In order to check that onboard the aircraft there is
enough room for the transport of the objects and animals mentioned in the
previous paragraphs 8.8, 10.4, 10.5
and 10.11, passengers shall contact the Call Centre in due
time before the departure. In case of failure to do so, the acceptance of such
objects and animals could not be guaranteed during check-in operations.
10.7 The applicable rates for luggage transport provided for
under art. 10.4, 10.5 and 10.11 shall be paid when they are checked during
check-in operations. The payment of the amount due is always made for every
single flight in the relevant airport at the ticket office of the airport
handler, which will charge passengers with a fee for the collection and issuing
of the ticket. Such a fee varies depending on the airport handler operating in
the different airports. The applicable rates for animal transport shall be paid
when purchasing the ticket.
10.8 Both on unchecked and/or checked luggage passengers are
required to put a label displaying their names, surnames and addresses.
Identification labels for luggage are available at the check-in counters of the
carrier inside the airport. Passengers are required to mark clearly all the
pieces of luggage to be checked-in with their name and address. The failure to
meet this requirement may result in long delays in luggage returning, in case
this is mishandled.
10.9 Without prejudice of the provisions of art. 10.1 and art.
10.2, the maximum weight allowed for each piece of checked luggage to be
transported in the hold is 32 Kg. and the maximum size is: width: 70 cm;
height: 80 cm; depth: 100 cm. The piece of luggage can be checked in at the
airport only if carried by the passenger, subject to the latter showing the
ticket during passenger check-in operations. Cardboard boxes can be accepted as
checked luggage provided that the name is reported on them and that they are
wrapped in cellophane and comply with the maximum size (70 cm x 80 cm x 100 cm)
and weight (32 Kg.) provisions. In any case, the piece of luggage to be
transported in the hold has to be properly solid and strong so to bear all
standard stresses relating air transport. Cardboard boxes, cases, packages or
single pieces of luggage whose weight exceeds 32 Kg. can be accepted as
oversize baggage provided that their weight does not exceed 50 Kg and their
maximum size is: width: 70 cm; height: 80 cm; depth: 100 cm. In addition to the
charge of € 7.00 per piece of luggage and to the excess luggage charge (due in
case of luggage heavier than 20 Kg, pursuant to the provisions of articles 10.1
and 10.2), the items described in this article are subject to the payment of an
extra charge which will vary according to the airport handler operating in the
different airports and which passengers will pay at airport handler offices.
The transport of luggage exceeding 50 kg or the size of 119 cm x 81 cm x 119 cm
will not be allowed on the aircraft, neither in the hold nor in passenger
cabin; such luggage is to be transported as cargo by a different carrier
dealing with cargo transport at passenger own responsibility and discretion.
10.10 The carrier denies any and all responsibilities for:
perishable or fragile goods with inadequate packing; moderate damage to the
external surface of baggage, such as (by way of example only) stains or
scratches, deriving from the baggage being used for its exclusive intended
purpose; damage due to water being poured on non water-proof baggage.
10.11 Transport of music instruments
Music instruments may be transported on board Wind Jet flights as hand luggage
only when their dimensions do not exceed those permitted by the carrier (cm
55x35x25) and prior to the payment of the applicable rate (€ 25.00 per
instrument per flight).
Passengers wishing to transport in the passenger cabin music instruments
exceeding the above mentioned dimensions (cm 55x35x25), shall book a seat in
the cabin directly at the Call Centre during the reservation procedure or at
the airport before departure (subject to seat availability), after payment of
the rate applied at the moment of sale.
In this case the instrument is to be transported inside a rigid, indeformable
case not exceeding the following dimensions:
length*: 130 cm;
width*: 45 cm;
depth*: 20 cm.
This size shall include also the possible foot mounted on the bottom of the
case (if not removable). The weight of the music instrument including the case
shall not exceed 32 kg. For all instruments exceeding 32 kg and/or the above
mentioned size (cm130x45x20), or when the passenger does not want to bring the
instrument onboard but prefers checking it as hold luggage, the passenger shall
pay 10.00 Euro/Kg for the whole instrument weight. In any case the applicable
law for possible refunds is the one in force for luggage. Passenger shall
attend the check-in counter 60 minutes before the flight’s scheduled departure
time, otherwise the instrument will be denied transport.
11. - Dangerous objects in the luggage
11.1 For safety reasons, the objects listed below are not
allowed in passengers’ luggage:
- Compressed gases - (deeply refrigerated, flammable, non-flammable and
poisonous) such as butane, oxygen, liquid nitrogen, cylinders for breathing
apparatus;
- Corrosives like acids, alkalis, mercury and wet cell batteries;
- Ammunitions, guns, pistol caps, fireworks and flares;
- Flammable liquids and solids such as lighter fuel;
- Matches, thinners, paints, lighters;
- Radioactive materials;
- Bags and suitcases with alarm devices;
- Oxidizers like bleach and peroxides.
- Poisons and infectious substances such as insecticides, weedkillers and live
virus materials.
- Other dangerous objects such as magnetic, blistering or offensive materials.
11.2 Passengers with FIREARMS and AMMUNITIONS (pax WAM), if in
possession of a valid gun licence will be accepted onboard the flights upon
payment of € 25.00 and only after undergoing national safety procedures. The
aforesaid does not apply to passengers belonging to the Carabinieri Corps, the
State Police, the Italian financial police, the penitentiary police, etc.
Many of the above listed objects may be transported as cargo if packed
according to cargo regulations.
11.3 The usage of any kind of electronic equipment is
forbidden onboard the aircraft.

11.4 The following objects may be transported on board except for the
limitations provided for by the new EU airport safety regulations:
• medicines or toiletries needed for the journey, up to a maximum of 2
kg or 2 lt.;
• alcoholic beverages, perfumes or colognes up to a maximum of 2 lt.;
• dry ice up to a maximum of 2 kg , only in the hand luggage;
• items used for smoking only if passengers keep them on. But fuel for
lighters, refills and lighters which contain unabsorbed liquid fuel are not
permitted;
• cardiac "pacemakers" containing radioactive material such as
plutonium batteries, only upon presentation of medical certificate.
• small carbon dioxide cylinders (including refills enough for the duration of
the journey) worn by passengers to operate their mechanical limbs;
• catalytic hair rollers containing carbon monoxide only inside checked
luggage. The cover shall be secured over the heating element. Gas refills are
not permitted;
• with the Carrier’s approval, small gaseous or air oxygen cylinders for
medical use up to a maximum of 2 litres. Liquid oxygen in never allowed into
the cabin.
12. - APPLICABLE LAW AND IMPORTANT WARNINGS
12.1 Air transport within the Italian territory is regulated:
- by the regulations of the Italian Navigation Code; - by the provisions of the
EC Regulation no. 2027/97 as last amended by the EC regulation no. 889/02 and
by the related exclusions and limitations on Carrier responsibility as provided
for by the EEC regulation no. 261/2004.
- by the Montreal Convention where applicable.
- by the Carrier's General Conditions for the national transportation of
passengers and luggage, and by the relevant regulations; the above mentioned
Carrier's General Conditions and regulations are an integral and substantial
part of these conditions.
Air transportation with final or intermediate destination in a Country which
differs from the country of departure, is subject to the provisions, exclusions
and limitations of liability stated in the EC Regulation no. 2027/97 as
modified by the EC regulation 889/02 and, for that which is not contemplated,
by the Montreal Convention (ratification and enforcement law no. 12 dated
10/01/2004). International air transportation is regulated by the Montreal
convention.
12.2 The exclusions and/or limitations of liability that apply
to the Carrier will also be extended to its agents, appointed persons or
representatives and to all corporate entities whose aircrafts may be used by
the Carrier for transport, as well as the agents, appointed persons or
representatives of the corporate entities. No agent, appointed person or
representative of the Carrier has the power to modify or eliminate anyone of
the provisions of these conditions.
12.3 A Carrier which issues a ticket for a transport which
will be performed by another airline acts only as a representative of the
latter.
12.4 Checked luggage will be delivered to the holder of the
Baggage Receipt.
12.5 The assessment of the checked-in luggage damage or loss,
within the national as well as the international transport, must be done in
writing, at the same time of the reclaim or at the time when the reclaim should
have taken place, by the appropriate forms, called PIR- Property Irregular
Reports, available at all airports.
The complaint must be forwarded to the airline:
- in case of damage, immediately after discovering it, or within 7 days at the
latest, as from the moment the luggage is collected, otherwise liable to
cancellation;
- in case of a delay, within 21 days from the moment the luggage is made
available to the passenger, otherwise liable to cancellation;
- in case of loss, if no news with regards to the finding of the missing
luggage are received within 21 days from instigating the Pir.
12.6 The name of Carrier may be written as an abbreviation on
the ticket. The full name of the Carrier and the abbreviation are present on
the Carrier's price list, regulations or flight schedule.
The scheduled stopovers are the ones indicated on the ticket or that figure on
the Carrier's flight schedule.
12.7 The Carrier may deny transport to any person who may have
purchased a ticket in violation of the applicable laws or rates and of Carrier
regulations.
12.8 Some special rates are subject to conditions which may
impose restrictions or forbid any change to the reservations.
The price of tickets may include some government taxes and several official
services, which sometimes represent a significant percentage of the cost of air
transportation. These taxes are included in the price, or are indicated in the
"taxes" box of the ticket.
12.9 The Carrier will do everything in its power to transport
passengers and luggage with reasonable rapidity. The hours indicated in the
schedules or elsewhere are not binding and are not an essential element of this
agreement. The Carrier may substitute other Carriers or change the aircraft
without notice, and may modify, if needed, the stopovers indicated on the
ticket. Flight schedules may be subject to change without previous notice. The
carrier denies any and all responsibilities for any flight connections.
12.10 The purchase of tickets by phone and email or the online
purchase of tickets are regulated by the provisions of the “Consumption
Code” Legislative Decree no. 206/2005 that apply to transportation
agreements and thus without prejudice of the exclusions stated by art.55
of the abovementioned decree.
13. - NOTICE TO PASSENGERS ACCORDING TO art. 6, No. 2, REGULATION (EC) No.
2027/97 AS MODIFIED BY THE REGULATION (EC) No. 889/02.
According to the Regulation (EC) no. 2027/97 as last modified by the (EC)
Regulation no. 889/02, the liability of the community air carrier for damage
due to death, wounds or injuries of the passengers, which occur on board the
aircraft or during boarding or landing, is not subject to any financial limit.
The Carrier may not deny or limit its liability, for damages up to the
equivalent of 100.000 Special Drawing Rights in ECU, by giving evidence that
all possible measures were taken to prevent the damage; in case of damage for
higher sums, the Carrier will be exempt from this responsibility upon
presentation of such evidence. The Carrier denies any liability for any damage
resulting from passenger's negligence. In case of immediate economical needs,
the Carrier is bound to pay the right holders an advanced payment proportioned
to the suffered damage, and in case of death, no less than the equivalent of
16.000 Special Drawing Rights in ECU per passenger. Wind Jet's Spa's insurance
cover for civil liability conforms to the Regulations.
In case of delay in the transport of checked luggage or passengers, the Carrier
is liable for the damage, unless it enforced all the possible measures to avoid
it or unless it was impossible to enforce such measures, without prejudice of
the compensation limits provided for by the Law.
In the transport of persons, in case of damage due to delay the liability
of the carrier is limited to 4,150 Special Drawing Rights per passenger.
In the transport of luggage, in case of destruction, loss, damage or delay, the
carrier is liable for up to 1.000 SDR per passenger, unless a special
declaration of interest in delivery at destination was made by the passenger
when the luggage was handed over to the carrier, upon payment of a surcharge.
In all cases of damage to checked luggage (destruction, loss, delay) if the
passenger that holds the right to baggage claim does not inform the Carrier of
such an irregularity, the Carrier will assume that the baggage was regularly
delivered in good condition and in respect of the transportation agreement. If
checked baggage is damaged, passengers must submit a claim in writing within
seven days, and in case of delay, within 21 days - in both cases they will
otherwise lose this right - from the date the baggage was made available to the
passenger. If Carrier receives no such claim, it will assume that the luggage
was delivered in due time and in perfect condition in conformity with the
transportation contract and passenger loses any right to claim or action.

reproduced, duplicated, copied, distributed, sold or exploited in any way for

audio pieces and software are property of Wind Jet and are protected by the
legal provisions on royalties.
15. - NOTICE ACCORDING TO THE LEGISLATIVE DECREE No. D. Lgs. 196/2003 –
PRIVACY PROTECTION LAW
Wind Jet manages all its Customer’s data in accordance with the
provisions of the regulation set forth under the Legislative Decree no. 196
dated June 30th, 2003 about the “Code for personal data protection” which
enforces in Italy the European Union Directives relating to such a subject.
15.1 The persons concerned hold the right to obtain a
confirmation or denial about the existence of personal data relating to them,
even when they still have to be filed, and to obtain that their communication
is done in an intelligible way.
15.2 The persons concerned hold the right to be given
information about:
a) the origin of personal data;
b) the purposes and modes of the data processing;
c) the logic applied in case the data processing is performed
by means of electronic equipment;
d) the identification details of the owner, of the people in
charge and of the representative appointed in accordance with the provisions of
article, paragraph 2;
e) the subjects and categories of subjects to whom the
personal data may be disclosed or that may come to know them in their role as
representatives appointed in the territory of the State, as people in charge or
appointed persons.
15.3 The persons concerned hold the right to obtain:
a) the update, change or, when this should prove useful, the
integration of the data;
b) the deletion, the conversion to an anonymous form or the
block of those data that are processed in violation of law, including those
whose storage is not necessary for the purposes for which the data were
collected or subsequently processed;
c) the declaration that the operations under letters a) and b)
have been communicated, including their content, to those to whom the data were
communicated or disclosed, except for the case when the fulfilment of this duty
proves impossible or implies using means that are clearly disproportionate to
the right protected.
15.4 The persons concerned have the right to totally or
partially oppose to:
a) due to legitimate reasons, the processing of personal data
concerning him/her, even if they are relevant to the purpose of the collection;
b) the processing of personal data concerning him/her for the
purpose of submitting advertisements or materials for direct sale or for
carrying out market or commercial communication research.
